There has been very little legislation pertaining to poker in Colorado recently.
The only significant development was Amendment 77, which removed any limits on the types of games permitted at Colorado casinos in Black Hawk, Cripple Creek, and Central City, plus removed limits on wager sizes.
Tribal casinos were exempt from the previous rules.
Is Poker Legal in Colorado?
It is legal to play poker at casinos in Black Hawk, Cripple Creek, and Central City, as well as tribal casinos. But online poker is not regulated in Colorado yet.
Despite this, there are many offshore poker sites available in Colorado. These are legally based abroad and, therefore, are outside the jurisdiction of state and federal law.
When Will Online Poker Be Legal in Colorado?
A legal framework for online poker was drafted in 2012. But that was the last movement in legalizing poker in the state.
There is little appetite to legalize poker in Colorado, so don’t expect locally licensed online poker in Colorado anytime soon. The good news is that anyone looking to play online in the Centennial State can easily join an offshore site.
Colorado Poker Laws
Colorado Revised Statutes, Title 18, Criminal Code, Article 10, Gambling outlines the state’s stance on gambling, banning it in most forms.
But in 1991, legislation was passed allowing casinos in Black Hawk, Cripple Creek, and Central City. These casinos are permitted to offer poker to visitors. Tribal casinos, of which there are two, are also permitted to offer poker.
Online poker rules are much simpler – there is no online poker licensed in Colorado.
But while offshore casinos are not locally regulated and operate outside the state’s legal framework, they’re highly popular with CO poker players.
Are Winnings Taxed in CO?
Any gambling winnings in Colorado are taxed as income, and as such are taxed at 4.40%, the rate of Colorado income tax. You’ll also need to pay federal income tax at a rate of 24% on winnings.
Casinos and poker rooms in Colorado will automatically withhold income tax on winnings, but only when you win more than a certain threshold. When this happens, you’ll be issued a W-2 G form.
